PAYMENTS, DEPOSITS, PRICING:

Billing arrangements for all events must be made in accordance with catering policies. There is a minimum 50% deposit on all catering parties unless prior arrangements have been made. Final payment is expected and due at the delivery or completion of the meal. Texas BBQ Services accepts cash, personal checks, most major credit cards, or company checks. If paying by credit card, a 3% surcharge will be added to the total price. Payment in full is also accepted. Pricing in this contract will be honored for 30 days unless otherwise noted. All printed catering prices are subject to change without notice.

GUARANTEES:

A seven-day guarantee is required on all meal functions. Texas BBQ Services must be notified of the exact number of attendees for whom you wish to guarantee payment. The Caterer will set up and prepare extra food over your guarantee as follows: The Caterer agrees to prepare for 5% over guaranteed number. This number may not be reduced once submitted. In the event a guarantee is not received, the original estimated attendance count will be prepared and billed.

LEFTOVER FOOD & BEVERAGES:

Catering on-location buffet style, we cook more than we expect to serve. (Running out of food is a traumatic experience!) We also have extended food temperatures and holding conditions to a point that we will not release leftover food to you or your guests. We trust that you will co-operate. (This policy is required by the Health Department)

CANCELLATION:

If the client cancels a contracted food and beverage event, caterer may retain any amounts in advance as liquidated damages and not as a penalty. The client and caterer agree that amounts constitute reasonable provisions for liquidated damages. In the event caterer must seek legal remedies to complete execution of this contract, client agrees to pay all damages including reasonable attorney fees.

DELINQUENT ACCOUNTS:

Texas BBQ Services reserves the right to assess finance charges on any amount unpaid when due at an interest rate of 1 ½ % per month or the maximum rate permitted by law, whichever is greater. A $35.00 Service Charge will be accessed on any returned check.

TAXES:

Unless otherwise specified and agreed upon, most items are sold on a per guest basis, with portion sizes having been determined by our experienced culinary staff. For more information about exact quantities, please do not hesitate to ask.

This agreement shall be binding upon and insure to the benefit of each party, their successors and assigns. The aforementioned policies are agreed to by both parties and constitute all the agreements between the parties. This written document supersedes and cancels any previous verbal or written agreement between the parties signing.

In consideration of the agreement between Client and Texas BBQ Services, Client agrees to indemnify, hold harmless and defend Texas BBQ Services, its individual team members, their heirs, assigns and personal representatives for any and all expenses incurred as a result of any claim for loss or damage to property and/or bodily injury asserted by Client and/or its/his/her special guest while attending an on-site event or cook-off.
